The movements of agricultural entrepreneurs for silvicultural interventions are allowed

Confagricoltura reports that the Piedmont Region has also intervened on the subject, again with regard to private citizens.

There are many entrepreneurs who have turned to Confagricoltura Piemonte to ask for clarification regarding a recent circular from the Piedmont Carabinieri Forestry Command concerning " movements on the territory by private citizens aimed at carrying out silvicultural interventions for the supply of wood for self-consumption ".

Both interventions exclude that this reason for displacement falls within those permitted by the Prime Minister's Decree of 3 November 2020 (art.3).

Confagricoltura Piemonte specifies that this exclusion only concerns private citizens and not agricultural businesses. Article 2135 of the Civil Code clarifies that "An agricultural entrepreneur is anyone who carries out one of the following activities: land cultivation, forestry, animal breeding and related activities ". The forestry activity is therefore proper to the agricultural entrepreneur .

The Prime Ministerial Decree of November 3, 2020, in art. 1, point 9 - letter ll) provides:

" Banking, financial and insurance services as well as activities in the agricultural, livestock and agro-food processing sectors, including the supply chains that supply goods and services, remain guaranteed in compliance with the hygiene and health regulations ".

Therefore - underlines in a note Confagricoltura Piemonte - any movement aimed at agricultural activities, including forestry, is always allowed.

Even if it were cultivation or harvesting for self-consumption by an agricultural entrepreneur - adds Confagricoltura - the case is clarified in the Government FAQ that we report below:

FAQ:

" Is it allowed, even outside the Municipality or the Region of residence, to carry out work on agricultural areas, even of limited size, used for self-consumption production, not adjacent to the first or other home?

Yes, the care of the land for the purpose of self-production, even personal and non-commercial, integrates the assumption of work needs, contemplated for the "orange" and "red" areas by Articles 2 paragraph 4 letter. a), and 3, paragraph 4, lett. a), of the Prime Ministerial Decree of 3 November 2020. Therefore the cultivation of land for agricultural use and the activity aimed at production for self-consumption (such as for example that of harvesting the olives, transferring them to the mill and subsequent pressing) are allowed, provided that the interested party certifies, with complete self-declaration with all the necessary information for the relative verification, the possession of this productive agricultural area and that it is actually used for the aforementioned purposes, indicating the shortest path to reach the site ".

There remains the need to produce a self-declaration that allows verification of the legitimacy of the move.
